Overview
El Salvador's Digital Assets Issuance Law (Ley de Emisión de Activos Digitales) was enacted as Legislative Decree No. 643, published in the Diario Oficial on 24 January 2023 and effective from 1 February 2023. It establishes a legal framework for public offerings of digital assets in El Salvador and sets requirements for issuers, digital asset service providers, certifiers and other market participants, with the stated aims of legal certainty, market development and purchaser protection. The law created the Comisión Nacional de Activos Digitales (CNAD), the national regulator that licenses and supervises issuers and digital asset service providers and maintains the associated registries. It also provides tax exemptions covering income and other taxes for qualifying issuers, certifiers and service providers.
