Framework: EU MiCA (Regulation 2023/1114) + Act on the Implementation of the EU Markets in Crypto-Assets Regulation.

Slovenia implements MiCA through the Act on the Implementation of the EU Markets in Crypto-Assets Regulation, which splits competences between the Securities Market Agency (ATVP) — authorising and supervising CASPs and asset-referenced token issuers, and policing crypto market abuse — and Banka Slovenije, which supervises e-money token issuers. Slovenia chose one of the EU's shortest transitions: the grandfathering window for legacy providers closed on 1 July 2025, roughly six months after MiCA became fully applicable. ATVP issued the country's first CASP authorisation in September 2025 (ESMA register date 20 September 2025) to Ljubljana brokerage Ilirika borzno posredniška hiša d.d., covering custody and administration, execution of orders, reception and transmission of orders and portfolio management; crypto-native firms Incrementum (6 November 2025) and Orcabay (10 November 2025) followed. At the time of the first licence ATVP reported four further applications pending, while roughly 24 EU-passported providers — including Bitstamp, Bitpanda, Coinbase, Kraken and Robinhood — served Slovenian clients under MiCA passporting.

Tax treatment

Slovenia currently does not tax individuals' occasional crypto gains — the Financial Administration taxes crypto trading only where it constitutes a regular, organised business activity. A government bill for a flat 25% tax on gains from disposing of crypto-assets (approved by the government on 17 July 2025 and intended to apply from 1 January 2026, with fiat conversion and spending as taxable events but crypto-to-crypto swaps exempt) was pulled from the National Assembly's December 2025 agenda at the ruling Freedom Movement's request. With parliamentary elections due in 2026, commentators do not expect the tax to arrive before 2027.

Travel rule applicability

Status: EU framework. The recast Transfer of Funds Regulation (EU) 2023/1113 — the crypto travel rule — applies directly in Slovenia from 30 December 2024 alongside MiCA, requiring CASPs to attach originator and beneficiary information to crypto-asset transfers.
