Overview

The Securities and Futures Commission (SFC) is Hong Kong's independent statutory regulator for the securities and futures markets, created in 1989 in response to the 1987 stock market crash. Its powers derive from the Securities and Futures Ordinance, comprehensively updated in 2003, under which it licenses market intermediaries, supervises exchanges and clearing houses, authorises investment products and enforces market conduct rules. It is funded independently of the government budget and reports on both investor protection and Hong Kong's competitiveness as an international financial centre. Kelvin Wong Tin-yau has been chairman since October 2024 and Julia Leung Fung-yee has been chief executive officer since January 2023. The SFC is the body responsible for Hong Kong's virtual-asset licensing policy, although it has been cautious in disclosure: in September 2023 it backtracked on publishing the list of cryptocurrency licence applicants. The SFC was established in 1989 after the 1987 crash exposed weaknesses in Hong Kong's market oversight, and its statutory framework was consolidated and expanded by the Securities and Futures Ordinance in 2003. In September 2023 it reversed a plan to publish the names of firms that had applied for virtual-asset licences.
