El Salvador made bitcoin legal tender in 2021, then rewrote the law on 29 January 2025 (passed 55–2) to satisfy conditions of a US$1.4 billion IMF Extended Fund Facility: private-sector acceptance of bitcoin is now voluntary, bitcoin can no longer be used to pay taxes or settle government debts, it is no longer defined as "currency" while nominally remaining legal tender, and the state Chivo wallet is being wound down. The IMF board approved the programme on 26 February 2025, releasing an initial disbursement of roughly US$113 million. The parallel LEAD regime (January 2023) governs issuance and services for other digital assets: reforms introduced on 16 August 2024 and approved by the Legislative Assembly on 3 October 2024 made the Comisión Nacional de Activos Digitales (CNAD) the sole regulator, supervisor and sanctioning authority for the industry — including tokens and stablecoins — removing the prior roles of the Central Reserve Bank and the Superintendency of the Financial System. Two licence tracks exist: DASP (digital asset service provider) and BTCSP (bitcoin service provider). More than 70 entities have obtained CNAD authorisation, including Tether, which relocated its headquarters to El Salvador; CNAD has authorised Tether's gold-linked aUSD₮ token.

Tax treatment

Since the 29 January 2025 amendment, taxes and government obligations are payable only in US dollars — bitcoin can no longer be used for tax payment. DeFi Intel has not re-verified capital-gains guidance for digital assets following the 2025 amendment; treat prior exemption claims as unconfirmed.
